On 17 June 2021, the court heard the appeal of political prisoner Bekizhan MENDYGAZIYEV against the cancellation of his preventive measure of restraint in the pre-trial detention facility.

The court upheld the measure of restraint in the form of arrest in the pre-trial detention facility.

On 5 June 2021, authorities sent Bekizhan MENDYGAZIYEV to a pre-trial detention facility for 2 months while he was being investigated in a politically motivated criminal case for alleged participation in an “organised criminal group”, “tax evasion” and “money laundering”.
The first political criminal case against Bekizhan MENDYGAZIYEV was fabricated under Article 296 Part 2 (“Illegal manufacturing, processing, purchase, storage, transportation without intent to sell narcotic drugs, psychotropic substances and their analogues”) for the planted bag of marijuana.

The authorities took Bekizhan MENDYGAZIYEV hostage in order to put pressure on his brother, Barlyk MENDYGAZIYEV, and force Barlyk MENDYGAZIYEV to stop his human rights and opposition activities.

Barlyk MENDYGAZIYEV helps pay fines,services of lawyers for activists and provides humanitarian assistance to the families of political prisoners and politically persecuted activists. Bekizhan Mendygaziyev has also helped to pay political fines and services of lawyers.

Other relatives of Barlyk MENDYGAZIYEV were also subjected to political persecution: Kalyk, Erik MENDYGAZIYEV, Rasim ALMUKHANOV – for allegedly stealing cattle (10 horses, 1 calf and a cable), Abai MENDYGAZIYEV (case for “possession of drugs”), Arman MENDYGAZIYEV (for alleged participation in an alleged organised criminal group), and colleagues: Baurzhan JUSSUPOV, Vladimir GOLIUSOV, Natalia DAULETIAROVA, Bakhtly DZHANTELEYEVA.
We demand the immediate and unconditional release of Bekizhan MENDYGAZIYEV and an end to the political persecution of Bekizhan and all of Barlyk MENDYGAZIYEV’S relatives and colleagues.

We call on the embassies of the United States, the European Union, the United Kingdom, and Canada to participate in the trial as observers and demand that the Kazakhstani authorities release Bekizhan MENDYGAZIYEV and cease the political persecution of Barlyk MENDYGAZIYEV’S relatives and colleagues.
